As a seller on the Baby Bunting Marketplace, you must ensure that you are aware of your obligations under the Australian Consumer Law (ACL) to report incidents to the ACCC when you become aware of a death, serious injury, or illness of any person which was or may have been caused by the use or foreseeable misuse of products you sell on the marketplace.

What is a serious injury or illness?
A serious injury is one that is:
- Acute – which means it arose suddenly (as opposed to gradually developing over time) and is brief and severe.
- Requires medical or surgical treatment.
- The treatment was provided under the supervision of a medical practitioner or a nurse.
Who must submit a mandatory report?
Every supplier in the supply chain of a consumer good has an obligation to submit a mandatory report when they become aware of death, serious injury, or serious illness associated with a consumer good or product-related service that they have supplied.
When must you report an incident?
You must submit a report within 2 days if you become aware that a consumer good or product-related service you supply caused or may have caused a death, serious injury, or serious illness.
How to submit a mandatory report?
- You must complete the report to the best of your knowledge within 2 days of becoming aware of the incident. You can provide further information later.
- Some incidents must be reported to a different agency.
You must inform Baby Bunting if you submit a mandatory safety report about a product you offer or have sold on the Baby Bunting marketplace. You may notify us via direct email to [email protected] or you may submit a ticket through our helpdesk.
